Standard Terms and Conditions
When booking a berth in a regularly scheduled class, standard terms are for a non-refundable deposit of 50% to be placed to hold the reservation. Berths are not considered reserved until the 50% non-refundable deposit is received at the Fair Wind Sailing Inc. office and prior to deposit receipt berths can be sold to others. A 100% non-refundable deposit is also required to secure a berth for an extra night on board.
The balance of payment (remaining 50%) for the class is due 30 days prior to the commencement of the class or when the course materials are shipped, which ever comes first. These terms shall also apply to fees for extra nights aboard any vessel. Once collected, all fees for classes and extra nights aboard are non-refundable. Late payments are subject to a $150 per person late fee.
When reserving for a special class (e.g. any class other than a regularly scheduled class), a non-refundable deposit of 50% of the class fee is required to place the reservation. The balance of payment for a special class is due 45 days prior to the commencement of the class or when the course materials are shipped, which ever comes first. Any additional fee, such as special booking fees, minimum attendance fees, etc., are due one week before the class begins. Once collected, all fees are non-refundable.
When reserving a private boat (e.g. reserving not just a berth, but the entire vessel), the entire fee must be paid at booking. Once collected, all fees are non-refundable.
Fees for outside activities, such as: diving trips, hotel stays, bed and breakfast stays, and travel insurance are due and payable upon booking and are non-refundable.
Cancellation and Refund Policy
Student / Passenger – Cancellation
We have a limited sailing season in each location. Moreover, we have a limited number of sailing berths available for each trip. In addition, to assure the quality of teaching, the number of students is strictly limited. Finally, standard operating practices in the charter / teaching industry is for bookings to occur 60-180 days prior to the class. For these reasons, Fair Wind Sailing experiences significant harm when cancellations occur.
If a student or other passenger cancels within 30 days of the class commencing, all fees become due and payable immediately and all fees are non-refundable. Fair Wind Sailing Inc. shall have no further obligation to canceling party once cancellation is acknowledged and is free to re-market the available berth at its sole discretion. If a cancellation occurs between 30-90 days prior to the commencement of the class, all deposits are non-refundable and all non-paid fees are waived. Fair Wind Sailing Inc. shall have no further obligation to canceling party once cancellation is acknowledged and is free to re-market the available berth at its sole discretion. If a cancellation occurs more than 90 days prior to the commencement of the class, all deposits are non-refundable and all non-paid fees are waived. Fair Wind Sailing Inc. may, at its sole discretion, re-market the available berth. If Fair Wind Sailing Inc. is able to re-fill the cancelled berth, it shall refund the deposit to the canceling party, less any discounts required to fill the berth, costs of any materials furnished to the canceling party and a cancellation fee of $250-500 (depending upon class and class location).
Any fines, penalties, or fees for outside services, such as: diving trips, hotel stays, bed and breakfast stays, and travel insurance shall be paid by the canceling party.
Fair Wind Sailing Inc. recognizes that outside circumstances, such as employment, health and weather can impact passenger plans. For that reason we offer travel insurance and strongly recommend that all passengers and students purchase travel insurance either directly from Fair Wind Sailing Inc. or from an outside party.
Fair Wind Sailing Inc. – Complete Class Cancellation
It is the policy of Fair Wind Sailing Inc. to run classes if at all possible so long as the safety of passengers and crew is not compromised. If it becomes necessary for Fair Wind Sailing Inc. to cancel a class prior to the commencement of that class, due to weather, vessel mechanical breakdown or any other reason, then students booked for the class shall be provided the option, as soon as reasonably possible, of either receiving a full refund for the class or rescheduling to another class. Fair Wind Sailing Inc. shall have no obligation for travel expenses or any other expenses other then the refund of collected fees. The offered travel insurance may cover other expenses.
Fair Wind Sailing Inc. – Partial Class Cancellation
If it becomes necessary for Fair Wind Sailing Inc. to end a class early due to weather, vessel mechanical breakdown or for any other reason other then damage to the vessel caused by a student, Fair Wind Sailing Inc. shall follow the following refund schedule:
- If student is able to pass all certification testing at early termination point of the class, the course shall be deemed to have been completed and no refund is due.
- If dockside teaching (knot tying, rules of the road, sailing theory, etc.) can be accomplished and student is subsequently able to successfully complete all certification within the normal period of the class, then the course shall be deemed to have been completed and no refund is due.
- If the student is unable to complete the certification testing, the student will be given a pro-rata refund based on the percent of days sailing versus the percent of days in the standard class.
- Ride along passengers and other non-students are not entitled to refunds beyond any discount negotiated prior to the commencement of the class.
